Welcome to GlobalNest. These Terms of Service ("Terms") govern your use of the GlobalNest platform, website, and services provided by GlobalNest B.V., a company registered in the Netherlands under number 98450721, with its registered office at Lindelaan 208, 1340 RO Almere, Flevoland, Netherlands.

By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services. We may modify these Terms at any time, and such modifications will be effective immediately upon posting.

User Accounts and Registration

• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account

User Conduct and Obligations

When using our services, you agree not to:

Orders and Payments

When you place an order through our platform:

• You make an offer to purchase the selected items at the listed price
• We will send you an order confirmation, which constitutes acceptance of your offer
• All prices are in Euros and include applicable taxes unless otherwise stated
• Payment must be made using approved payment methods
• We reserve the right to refuse or cancel orders in certain circumstances

Delivery terms, shipping costs, and return policies are provided during the checkout process and may vary depending on the designer or product.

Intellectual Property

The GlobalNest platform, including its design, functionality, text, graphics, logos, and software, is owned by GlobalNest and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute our content without permission
• Reverse engineer or attempt to extract source code
• Use our trademarks or logos without written consent
• Create derivative works based on our platform

Designer content, including images and product descriptions, remains the property of the respective designers and is used with permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by law, GlobalNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, incurred by you or any third party, whether in an action in contract or tort, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you have paid to GlobalNest in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. We do not control and are not responsible for the actions of designers, the quality of products, or the accuracy of product descriptions.

Indemnification

You agree to defend, indemnify, and hold harmless GlobalNest, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your use of our services
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct in connection with our services

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the Netherlands, and you hereby consent to personal jurisdiction and venue therein.

If you are a consumer residing in the European Union, you may also bring proceedings in the courts of your country of residence.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings.

Upon termination, your right to use our services will cease immediately, but provisions that by their nature should survive termination will remain in effect.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision will be struck and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our platform, constitute the entire agreement between you and GlobalNest concerning our services.
